Ash - HELP!!

The free 360 Elite I won from you October last year has died with the 'open tray error'

Microsoft want to charge me because technically you bought it about a month previously and the warranty started from then!! GRR!! Apparantly who ever sells it logs when the particular serial number has been purchased and as you didnt buy it under the guise of a reseller you are infact the end user not me!!!

This is not an issue with you at all, but just shows how fickle Microsoft can be!! If it had RROD no problem at all... does anyone know a non invasive way of creating this??

I spent 45 minutes venting my spleen at Microsoft... to no avail. I am in retail and if a customer orders a warrantied product but gets it delivered a month after we have taken delivery they do not lose a month of their warranty.

This may be down to the way in which the product was bought, if it had been bought as a trade item then it may not have been the issue.....

Re: Ash - HELP!!

rap a towel around your xbox and leave it on all night... or in a really stuffy cupboard... but that might be pretty hard with elites... as they're supposed to be better and have no ring of death....

but you never know!

just shows how crap microsoft are...again

Re: Ash - HELP!!

you need to take this up with whoever ash brought it from, sale of goods act is usefull in these cases, but its between the customer and the shop, not the manufacturer (apart from a few products)

Re: Ash - HELP!!

sale of goods act.. that takes me back!!

third party contracts and all that.....

Contracts (Rights of Third Parties) Act 1999

(1) Subject to the provisions of this section, where a third party has a right under section 1 to enforce a term of the contract, the parties to the contract may not, by agreement, rescind the contract, or vary it in such a way as to extinguish or alter his entitlement under that right, without his consent if—

(a) the third party has communicated his assent to the term to the promisor,

(b) the promisor is aware that the third party has relied on the term, or

(c) the promisor can reasonably be expected to have foreseen that the third party would rely on the term and the third party has in fact relied on it.

law qualification will come in useful after all!!

Re: Ash - HELP!!

My brothers xbox had this problem.

It is not advisable to take it apart as this affects the warranty, but if you can not resolve it through xbox and you need to fix the tray, they say its the rubber band. if you look on you tube they show you you just take it out and clean it.

My boyfriend did this to my brothers,as he brought a new one. He found that after cleaning the band, that a washer was also loose and that ended up being the issue of the tray error.

Hope you get it fixed
