Does this happen on all networks?


Afternoon all,

First off: I am not slating giveaway network with this, I'm just frustrated!

I recently finshed collecting enough greens for my first gift, a PS3 on sonyps3giveaway and was really excited about the prospect of getting my grubby little mits on it. However, after clicking on verify my account was put on hold after a few days wait due to "fraud" as my girlfriend had an account registered on the same site to the same address and was hoping to collect a second PS3 for our flats media centre if mine acctually worked.

Although i realise now that it is against the the T&Cs, at the time we though it was ok just to two have accounts that weren't referring each other, which we didn't do as on my brief skim through the T&Cs I clocked that as something they count as fraud (which I don't condone).

Anyway, back to the point. i got in touch with giveaway network, who were nice enough to explain it is in their T&Cs and offered me to change over to another one of their sites for a PS3 and lose all my greens. Now i know you should read the T&Cs first, but it still strikes me as unfair having to lose all my greens. For future reference, does this happen on any other networks?

Note: If I do decide to collect through them again it will be via a conga on here, so that at least someone benefits apart from them, and its not just me losing my greens.

EDIT: Another reason I ask is because I was tempted by two of the TVs on the hdtv.giveaway and ideally wanted to try to run the offers parralel or at least one after the other

Hi Stebo,

I can't comment on how other networks work, however we (ForFree4U) look at things on a case-by-case basis. We do operate a strict one account per shipping address policy (as many other networks do), however show leniency in special cases. Without going into too much detail, we look at a number of factors when placing an account on hold.

Hope that's cleared things up for you.

It's a difficult one as you had actually read the T and C so should have been aware. Obviously giveaway are entitled to put you on hold in accordance with this.

But at the same time i do have some sympathy. How many greens does your girlfriend have?? Perhaps you could ask them to cancel her account and keep the comission money from her greens and give you the PS3 from your account as a compromise and as a goodwill gesture you will write a very positive post on Exceem about how understanding, synpathetic etc giveaway are.

This would seem a fair compromise as depending on how many greens your girlfriend has giveaway could potentially make a lot of money from this AND come up smelling of roses on Exceem. Plus you still get one PS3 which is not as good as two obviously but still better than none.

Worth a try i think.

I would maybe argue the case to lose half your greens... not all... but Giveaway are very firm with their t&c's...

In regard's to the first post, even if it is in their T&Cs, I find that extremely harsh.

I respect the policies, of course, but if you and your girlfriend didn't even refer each other once, and you have proof of this, then surely there must be some sort of case in it for you. It was against the rules, fair enough, but being told this after you'd gathered all greens together, probably paying in the process, is not on, I feel. In that sense I agree with the_icks. I think you should get a certain amount of referrals cut from you, but not all your efforts being wiped out.

Cheers for the quick replies guys.

My girlfriend had no greens or yellows on her account as we wanted to play it safe , so unfortuantely no exchanging (or cancelling of the account) possible.

They did offer me to switch over to nextgen.giveaway, but did not offer any credit transfer. Will ask and let you know how it goes.

I can see why you've been put on hold but if you haven't referred each other (which you haven't) and your girlfriend hasn't started working on her account (which she hasn't) then surely they must be able to see that there is no intent to commit fraud?

If what you say is true then it sounds like an honest mistake, and I would hope that they would simply cancel your girlfriend's account and verify yours.

Erm, he was told before he got the greens. It's in the terms and conditions and there is a box you tick when you sign up to say that you have read and understood them. It's a bit cheeky to indicate you have read them and then say afterwards when you break one that actually didn't read them and they are a bit harsh!!

Whilst i have sympathy for him and don't want to sound mean i think he knows it's his own fault!!

If your girlfriend has no greens then it reduces what compromises you can come to. In light of that i think what the icks suggests is, whilst not ideal, probably the best bet. Like i say if you offer to write a praising post here and get your girlfriend to send an email explaining that it was a genuine mistake etc. then you may be lucky.

Fingers crossed for you anyway. Even though it's in the T&C's it would be a shame for all that hard work to go to waste.

And I agree with that but I just feel his situation should be given the opportunity to be looked into. Giveaway certainly don't have to be leniant, as it's a rule stated at the beginning of signing up, but I feel this is more of a genuine mistake and can be sorted out with words. He should be given another chance for referring so many people in the first place I feel.

I'm guessing that that is part of what verification is. When they verify your account they verify you do not have multiple accounts which is why it wasn't done earlier.

I am on his side and think there is a compromise that can and should be reached, but genuine mistake or not this probably wouldn't have happened if he had read the rules. And in any case, look at it from Tab's point of view (a controversial thing to do on here i know!!) how can he know it was a genuine mistake and not fraud?? It seems genuine but what if every person who had actually tried to defraud them just said "sorry, let me off it was a genuine mistake"??

I think the moral of this story is to read and understand all terms and conditions.

I know it is like bolting the stable door after the horse has bolted but I wish you had made an account on PS3giveaway and one on next-gen.

On a positive note, at least you know that you are able to get greens by whatever means so hopefully you can again.

Unfortunatly, I dont think giveaway will budge on this. I have every sympathy with you and the situation but if giveaway decided to change the rules just for you, I reckon there would be a few angry exceemers who had been put on hold for similar things and not been allowed off hold.

Hopefully something can be done though.

We started theses accounts way back when there was only the ps3giveaway site.

Although I agree with everyone that T&Cs should be read (and whenever I'm handing over my money at shops I do), how many of us read all of the T&Cs/User agreements when installing new software or signing up for an email account - With those (usually) if you've read one, you've read them all (and when it comes to software basically sold any rights you thought you had to Microsoft/Google)

You have my sympathies mate. I had a 6 week "discussion" with giveaway over my account. Eventually they agreed that I had not commited fraud and hadn't intended to commit fraud.

I agree that the T's & C's are their to protect the networks, but in cases such as this it really riles me because the network has just made a minimum of £200 out of this person and pocketed it on a technicality.

During my dispute I started looking at "The Unfair Contract Terms Act 1977". I'm not going to pretend to know how law & court cases work, but having read a bit up on the above Act there's a lot in the T's & C's that I think would fall under that act. If someone were going to go that far or has a solicitor in the family it may be worth getting the low down on how usefull that would be in any dispute.
