Were there no witnesses of the crash? Also, didn't you mention there was a CCTV camera at the place of the accident, might be worth trying to get hold of the footage to add to your case.

My dad witnessed what the guy said after the crash, which is completely opposite to what he is saying now. I also have a few work colleagues who pulled into the car park after me and heard the altercation. Weather they saw the crash I do not yet know.

Don't suppose that would help in anyway.

I still need to trace the CCTV, likely hood is they wont have it now.

All cctv for the roads towns cities is archived off, they will have but it may be small charge to get your hands on it. Contact the highways agency for that area they will know who the controllers are.

Yea the whole 50/50 thing does affect your no claims because the insurance company (yours) will be paying for any damages to the other party. Even if you didnt make a claim, they are incurring a cost because you made them due to a 50/50 claim.

Your father cant be used as a witness because it will be seen as you made him say those things. I guess you could have recorded the conversation at the time, but I guess people dont think about recording conversations because they were just in an accident lol.

next step is to use the right turning thing you mentioned before and bring it up on the cameras.

I would say even if there was a charge for getting a copy of the footage it would definitely be worth it - it would be much less money to pay then the big jump your insurance premium as well as the loss of your no claims.

You have nothing to lose by trying so I'd say go for it if it can save you ££'s in the long run.

You can't use co-workers, friends or family as witnesses due to the fact they will fight on your behalf and be biased. Was there anyone passing by that takes the route regularly which you can speak to?

if i was you, i would contact the lying ****er and say your getting the cctv for the road to prove he hit you and that you will also prosecute for perverting the cause of justice blar blar see if he changes his tune.

The Highways Agency will only release CCTV footage to your insurance company or solicitor.

If it was a third-party camera, you can request a copy if you can identify yourself in the film, not sure if that extends to a car. They can charge up to £10 and have 40 days to reply.

Highways don't deal with it and the council only keep it for 31 days.

I feel as though I am in a good position to pick apart his story, but I need to see it. Apparntly his company isn't playing ball. They mentioned something about lane markings which I HOPE they do because if you streetview the location you can clearly see that if your in the left hand lane it leads you to the second exit, whereas on the right lane there is a break in the markings to carry on or continue.

I'll get a screenshot up later on to show you.

Thought I'd give ya'll a quick update.

After numerous phone calls to my insurance company, they told me that there argument is that I could have taken the same exit as him and for that reason they will not accept full liability, which means he must have told his insurance company that he was taking the third exit....howwwwever, I have a witness statement from one of the shops staff that asked him a few questions (he went in and asked them to call the police) and the statement clearly says that he told the shop assistant "I was going right around the roundabout" to which the shop assistant asked, "But you were in the left lane" and he said "Yes, you can do that!!"

Which as we all well know...you can't

Add that with a small side order of lane markings also showing that you CANNOT take the third exit in the left hand lane and we SHOULD...SHOULD have this won.

Need to get them faxed off and cross everything

Investing being the operative word, we will see how payday comes along but yes I think they are a smashing idea and should be in all cars as standard - would cut so many disputes.

Roadhawks are well expensive.
I've been using one of these IN CAR NIGHT VISION VIDEO CAMERA RECORDER CCTV HD DVR TFT 2.5" LCD ROAD ACCIDENT | eBay might not be same seller but deffo same camera, and have to say the quality isnt bad at all even at night. 4gb sd card and you have hours and hours of recording although for any accident you only really need a min before the incident.

I agree they're great, the only problem is hey aren't admissable in court at the data isn't secure, hence roadhawk or smartwitness.

The cheaper ones are great for stopping you getting to court, as they probably wouldn't chase the case, but if you did land up in court your evidence wouldn't be used.
