Really really angry.

As i'm sure you know I recently sold my Prada phone that I recieved from Xpango Thanks again

Put it on an online auction site and accepted paypal for it.
That was all fine.
Unfortunatly the person who bought it sent payment to the email address I have registered to ebay and not the email address I have registered for paypal. Not a problem as I simply sent it to the other email address.

Just checked my emails (the ebay address) and "Temporary hold pending investigation" . . can't believe it, the person has withdrawn their paypal payment.
I thought they could not do this!!
Now my account is overdrawn and I have posted the phone, I have sent it recorded delivery and they have actually signed for it.

Thing is my acount is overdrawn even though I have not done anything wrong.

Simply question, am I going to end up out of pocket?

Withdrawn by £350 . . really really gutted. The person is based in Ireland so I can't exactly go there but if they were within england I definatly would have went round and either got my phone or money back.

Feel gutted, I never get skanked . . . except from Freepay . . . oh and Fummo

Did you have paypal protection?? Have you contacted PayPal?? If they have signed recorded delivery and you have kept the receipt you should be able to sort something out with PayPal, raise a dispute.

Not sure about Paypal protection (think so, how do I check?)
I have the receipt for insured postage . . .I never get skanked this has made me not want to use paypal anymore.

It's raised as a dispute in my account, but my account balance is overdrawn £350 (which I can't afford)

Hey legal man surely they can't lend me that money without me signing some form of credit agreement therefore they are not entitled to ask me for it back?

I don't think it is a credit agreement, i would have to check though but i doubt it.

If you go to the transaction details in paypal it should say somewhere on the page if it is eligible, usually in green writing and pretty obvious somewhere.

Did the other guy raise the dispute or have you raised it?? If he raised it what did he say??

Legally you can sue for recovery of the money, but in practice it is not that easy and would be expensive. You could write a professional looking letter to him explaining you are seeking legal advice with regards to taking action in the civil and criminal courts but if he returns your item or gives you your money back you will cease.

You could also phone the police, this seems fairly obvious to you and I to be a case of Fraud and hopefully the police will think so too.

See what happens with PayPal first before you do anything else, they have always been good when i have had disputes (though nothing as serious as this i admit). When you speak to PayPal stay calm and detached -try not to get emotional or too accusatory, just detail the facts with dates and reference numbers in a chronological and methodical manner. Type what happened etc out into a word document and read it over several times. Ask yourself if someone who didn't know what had happened read the document could they follow clearly what had happened. Do this with every PayPal communication.

If you do it like that they will be able to follow what happened and will usually be more sympathetic to someone who doesn't appear to be ranting and raving at them.

I feel for ya dude because that is a lot of money and a tough thing to happen, and i hope PayPal sort you out. Keep us all updated with happens with posts (other may have more advice on this sort of thing ) and feel free to PM if you need any more help.

how can you be overdrawn, if the money went into your account and came out again that's back to 0. If the money went into the wrong account and you transferred it elsewhere, then they took it out fo the wrong account, then you still have the money elsewhere to return the wrong account back to 0, although you will still be sans dog & bone. The fact it's been signed for has to be a big weight in your favour. check the listing on ebay, it should say on it whether it qualified for protection.

Thanks for all the info guys.
Feel proper gutted, thing is let's say for example my paypal account is now overdrawn where I have transferred the money to my bank account. What will they do if I simply tell them I am not paying the money back?

@Landy . . if you read my first post, I have 2 accounts. He sent it to one, as soon as it was in I sent it to the one that is linked to my bank account. Then as you say the money came out, but I had also sent the money out . . thus overdrawn

verified buyer/verified address? if neither you are buggered!!!

did the buyer have much feedback?

Seller protection just stops buyers from claiming they have not recieved the item and claiming against you... sellers get very little protection.. technically you were paid.. it is not as if a cheque bounced.. PayPal have no obligation to pay and I am sure they will justify not paying!! All it takes is somebody to claim fraudulant use of their PayPalaccount and thats it!!! They do not even have to prove it!!

Have you emailed the other guy?? What does he say??

They must have a PayPal address, how could they send you payment through PayPal if they don't have one??

What was their Ebay feedback like??

Like i say, see what the other guy says, see what PayPal say. Keep all emails and other documents and wait and see for now. If you get nowhere with either then post on here and we'll take it from there.

Feedback of 9 . . .I know it's low but it showed that they had dealt with a few people before and everyone has to start somewhere.

What kind of email would you write? to the other party?
