Sorry to burst your bubble but you cannot run a a prize draw offer without a license/permit.

I pointed out in your last thread that you have stolen content from other websites, you've ignored this and have kept the content up.

I'd remove it if I were you, unless you like the idea of being unpopular on here.

Can i just say the majoroity of the content on my site is my own and if hasnt changed on your pc why dont you try clearing the cache? And also the majority of the pictures came from google images in the first place and the rest i have put together my self. The problem is you seem to have grudge against me no matter what.
And about the prize draw you are the only person that seems to have a problem with the idea ArticFox didnt even have any problems!

err, first of all when I looked at your site, I saw no mention of a prize draw, I only saw that after I had posted or I may have wrote the same thing as az87aris.

I dont think he has a problem with you having a draw, he's simply pointing out the fact that "officially" you would need to have a licence to run a raffle/lottery etc. It's been posted in a few posts on exceem, which is why he's brought it to your attention.

You might have got them from google images, but they are actually from other people websites. The stolen content I was talking about was actually the text content on a few of your pages. One of the sites you have stolen from is eonbar's iMoose website which I can't see him being happy about.

And I wont be the only person with a problem with the prize draw idea, you do need a license/permit to run prize draws/raffles.

And I don't have a grudge against you.

Also, just because you find images on google, doesn't mean you can use them without permission.

ok then i apologize and what i shall do is rephrase prize draw to competition as i have just done some research and you do not need a licence for competitions and the content i have been recently modifying yes i understand some of the text does need changing and i am working on that but i am having juggle exams at the same time.
Picture wise i did not realise this so i shall try and resource the remaining and substitute with my own.
have i missed anything off that let me know and i will try and get it sorted to keep everyone happy

I'm viewing your site via iPhone and may have missed something but struggled to find a "sign up" button. You need to draw people's attention as quickly as possible.

As for the special offer, it doesn't matter if you call it a draw, bonus, competition etc, if you have to sign up and take an offer to enter, then it comes under the gambling regulations.

ok well i shall add another sign up button and as regards to regulations i did a bit of research on google and the results i got back said that companies use competitions in the way i have instead of prize draws in order to get round regulations. Im not saying your wrong or anything im just going by what i got back from my research

Looks like i need to adjust my t&cs
I have just found this site
http://www.out-law.com/page-6780
it is very useful on this topic and as long as there is no need to pay for anything then it is not classed as anytype of gambling because there are offers that do not cost anything i dont know what your opinion on this is guys let me know
Now i shall continue to read on!

it's been covered a hundred times, and the end result is... you cannot without a license have a competition which requires people to complete an offer, free offers or not.

Like myself and others have done you can have a comp with A. B. C. answers free entry but they don't generate much traffic or greens as competition people are tight arsed mofo's who want everything for free, the irony.

i agree with what your saying but the site which i posted above only states a requirement for a license is when there is a need to pay money to enter but because i have now added that there are free offers on the site that can be completed to enter.
It also states that if there is two seperate ways of entering one with paid and one with free then it is not classed as gambling as long as the free entry is clearly shown or stated. and as long as there is no discrimination between the two groups.

Sorry if im becoming a headache for you

Free offers or not, if people have to complete an offer in order to enter your 'competition', this requires a license/permit.

I am just going by the UK gambling regulations documents and as there is no need to put money into it to enter, it does not require a license/permit to have it in operation.

Why bother asking for advice when you have already convinced yourself otherwise?
Don't come on here crying if you get reported and end up in trouble.

Quoting from the site you referred to:

"Even if there is a paid route to enter, a competition will be treated as free to enter if there is an alternative free entry route, provided that:
  • the alternative route is a letter sent by ordinary post or some other communication method which does not involve payment and is no less convenient than the paid-for route;
  • the choice is publicised in a way that is likely to come to the attention of all those intending to participate; and
  • the system for allocating prizes does not discriminate between the two entry routes.
The Gambling Commission thinks that web entry may not always satisfy the requirements for an alternative free entry route".

Let me know your address and I'll get my entry letter in the post

Only you can convince yourself whether it is worth breaching the rules. If you interpret those differently to some of the members here, then it's your risk to take.

Furbs

iPhone4Matt will become famous soon enough
and of course you have probably annoyed some people here now which are likely to report your competition/raffle/giveaway/prize draw. oh and the animated sign up...offer...refer...receive image isn't yours so might be worth checking with Ryan1087 and MJ10 if you can use it.

Thanks for that furbs
Tbh I don't even think the idea will work I will give it until a week today and I will make my decision then as to whether I take it further because as you say I'm the one risking it and tbh it was just one of those ingenious ideas that if it worked would be great
