There is obviously no issue with anyone who has placed their order or is awaiting goods from Reversebid. Those are confirmed debts.

As for everyone else, I've discussed that with the IPs here. The general view is that people shouldn't be denied the right to claim as a consequence of the companies failure to update pendings, deal with custom order requests or verify accounts (over an eight month period!).

If I were running the case I would provide full information to anyone whose account was unverified. I would not, however, look at agreeing those contignent claims in the liquidation unless and until there was money to pay out. If that point ever came and the amount at stake was worthwhile, I would probably look to update everything and run a final verification at that stage.

At the end of the day though, whoever takes on the case will make their own decision on how to deal with things.

thats presuming

a) that there is still a TD account to verify any outstanding pendings.
b) the information is still available, people cannot access their accounts to confirm details. So all about trust. And Giveaway never had a custom/per green rate anyway so there is no obligation for people who have not completed/clicked toe order button (I may be wrong)

I would agree with you in an ongoing scenario but not now, where people cannot verify (or get the greens they need to verify) due to GA's failure.

but surely if they offered an either/or scenario then there is no 'also'

people with single greens have not completed their side of the contract... I mean, yes it is 'partial consideration'

Be interesting to see, I have a couple of single greens, and a couple of offer completions.

I'm only expressing my view on how I would deal with if I had the liquidation. As I said above (unfortunately, not in very good/clear English it seems), I would accept that people had potential claims but only worry about looking at those more closely if there was money to pay out.

We're back to famously speculating again though and I am not planning on getting into arguments in an open forum that GA can presumably still see.

You mean to be the guy who runs the company, realises the assets and dishes them out?! Big conflict of interest to have a creditor of the company doing that!!

Not that i'm doubting Furbs integrity (and i'm sure he won't mind me saying this) but would you want someone who is owed money from them handling that?! I wouldn't, whats to stop them paying themselves to the detriment of everyone else? That's where the conflict is.
