I have given them 7 days from yesterday to respond to my latest ticket, then it's the small claims court. I requested the name of the company director to direct the claim to, so don't imagine they'll respond. Not really sure where we stand legally, but I guess I'll find out.

All you need to do is file your claim with the particulars of claim and pay your fee and then Fusion Media will receive a Defence Form which they have 14 days to reply to, if they intend to defend, or 28 days if they file an acknowledgment of service. If they don't file a defence by that date then you will be able to request judgment in default, which is automatically granted, without referral to a Judge if they have not replied. The problem you will have then is the enforcement of the judgment, which is a difficult thing to do against a Ltd company and for that you may require legal advice. If Fusion Media Ltd do decide to defend the claim, then the case will probably be referred to the Small Claims Track at your local county Court to be heard before a District Judge, be warned though as this type of hearing carries a fee of approx £200 which you have to pay upfront but if you win then it gets added to the judgment, however you then need to enforce the judgment, which is the tricky bit. I hope this info has helped, I used to work in a County Court in case you were wondering! | |
