Very Annoyed, any advice?

Not sure where to post this but i'd say it fits ok in the general section, anyway here is a little story called "Freepay placing me on hold"...

Ok well if you read my blog then you will have read today about my account being placed on hold for the gaming.freepay network. I am right now just 5 away from a PS3 and kinder pissed right now.

Ok the story so far, to keep thing short I logged into my account 2 weeks back to find my account had been placed on hold and that one of my referals that had gone green had been removed.

I sent in a report ticket requesting a reason for my account being placed on hold, today I got a responce.

Quote:
Thanks for contacting us,

Your account was placed on hold for unwelcome mass posting of your referral link and as a result of various complaints against account.

Due to the overwhelming amount of fraudulent claims we receive and the fact that we give away hot ticket items for free, we are forced to be very strict in the enforcement of our Terms. Your account will remain on hold indefinitely.

We are sorry that this matter could not be resolved to your satisfaction.

Sincerely,

The FreePay
Customer Service Team
Now I can honestly say to you all I have not posted any of my referral links nor my site in any form of mass posting. I am kind of annoyed cause since I restarted the freebie thing I wanted to keep things honest and stick to the rules and show to others what is possible without having to be annoying and spamming the heck out of the place.

I have responded to Freepay and requested that they give some kind of proof or I will take action, the last time I had issues with freepay was back when I was getting an Xbox 360 and they took 3 months to send out gift.

I am annoyed since I have put a lot of time and effort and some money into getting this to work just to have them steal it away from me.

Is there anything I can do?

Surelly they can't just cancle my account out with out some kind of proof?

Thanks

Gary

Re: Very Annoyed, any advice?

I agree with you Garyl2k, although I have never been in the same situation I would have thought proof would be required if you were to take it further. Otherwise networks could choose to place all accounts on hold and keep the money. The network in question should be able to provide you with the complaints your account receieved and depending on what activity had been completed you maybe able to get the ip address of who placed the spam. It then may even be possible to see if this ip is even from the same isp as you.
I have completed several networks now, and have found most to be very good although some are alot slower at Verifying, Delivering and Support. But FreebieJeebies are by far the best in all areas in my opinion.

Re: Very Annoyed, any advice?

sorry but going by their terms and conditions..

Quote:
VI. HOLD

1. Common Reasons for Being Placed on Hold

(a) Multiple accounts.

(b) Fraudulent referrals.

(c) Negative feedback from one of our affiliates or offers being completed and immediately canceled.

(d) More than one account at a user’s shipping address. A user must have a valid email and mailing address for any or all of the FreePay websites that are offered in their respective country. The user should note that products cannot be shipped to P.O. boxes and that we only allow one account per mailing address. See Section III(B) for a list of FreePay websites.

(e) Posting information on a website, forum, or auction that has to do with "canceling the offers" included, but not limited to, cancellation phone numbers, cancellation time frames, and any encouragement or direction to cancel the offers after signing up with them.

(f) Bidding on trademarked keywords associated with our advertising partners or their affiliates in Internet search engines to gain referrals through sponsored search results. (e.g. Bidding on the keyword "Blockbuster" in Google and appending your referral link to this bid upon keyword.)

(g) Posting your referral link in places where it is not welcome, or spamming your referral link online in any capacity is strictly prohibited. If we see or receive complaints about your referral methods that we deem risky, we may place your account or accounts on hold.

(h) Purchasing a domain name with the sole intent and purpose of automatically redirecting visitor traffic to any one of our FreePay websites that includes a user's associated referral link without the visitors' knowledge. (i.e. not explicitly stating on the website of purchased domain name that a visitor who signs up for an account will become an existing user's referral and therefore help him/her with achieving their free product)

(i) Any other reason or a combination of reasons at the sole discretion of Gratis Internet.

2. Additional terms regarding "hold" status

(a) We reserve the right to place a user's account on hold at any time.

(b) We are not responsible for notifying a user about his or her account being placed on hold.

(c) If an account on any Gratis Internet website is placed on hold, all other accounts across all Gratis Internet websites created by that individual may be placed on hold as well. Moreover, all orders from any account created or connected to this individual may be frozen and the user will be unable to order from any of the Gratis Internet websites.

(d) A user who has had his or her account placed on hold may not create another account on any Gratis Internet website.

(e) A user's account may be placed on hold indefinitely.

(f) A user may not receive any reimbursement for points or referrals accumulated prior to being placed on hold.

(g) If a user feels that he or she has been placed on hold in error (i.e. has not acted against the terms of Gratis Internet), he or she may contact us via our website.

(h) We reserve the right to place a user's account on hold after they have gotten credit for a free item, and even after ordering and receiving their free item. We also hold the right to follow up legally on fraudulent activities.
they don't have to tell you anything...

Re: Very Annoyed, any advice?

Thanks for the responces guys, maybe the_icks is right and some ones reported me for no reason but why I don't get that?

Even if that is the case i'm sure there would have to be a number of complaints before going ahead with placing an account on hold?

Anyway I will look more in to this, djerwood I 100percent agree with you that they can't just place you on hold without proof of the reasons they have given.

Also ToC are not bound by law, if it stated on their ToC that if you signed up to their site they are allowed to punch you in the face because it stated it in the ToC does not make it right or that it will hold up in court.

I have seen a few things posted on the web regarding the BBB (Better Business Bureau) which looks in to unfair treatment to customers from online businesses. I will look more in to this and get back with more information.

Oh I'm not too sure what the URL was for the 360, was almost 2 years ago and so much has changed since then.

Time for sleep! night guys

you sure the 360 didn't come from gaming as well then ?

and reading their terms and conditions, they do have the right to put you on hold and surely they have terms and conditions to cover themselves.. i might be wrong but surely their terms and conditions would stand up in a court of law hence them having them.. it might be unfair but i can't see that they've done anything wrong.. as its been said on here loads before, its one of those things that happens...

Just read this now and i know how you feel mate. I got put on hold when i was waiting for a 32" flatscreen and 2 iPod touches but it was really my own fault. Freepay are always spot on when they put someone on hold, i've read A LOT of stories about how freepay wrongly put someone on hold even after freepay's explained to them why.

They're really straight forward and won't give second chances, my advice is move on. You know exactly what you're doing right now with all your SEO knowledge, i'm sure you'll get over this and go on to recieving gifts like crazy. Hope you see this yourself and move on to a site with a better design and better support ( RI ). Good luck

No it couldnt have since my account would be a breach of the ToC, anyway thats not what the excuss they have put me on hold for its for so called "unwelcoming of mass posting of my referral link" which is crazy since I have not once posted my referral link on any site other then my own.

I'm sorry but if placing some one on hold and accussing them of something they have not even done and not proofing it is not wrong then we live in a very sad, sad world.

Sorry to sound harsh CD02 but to me it sounds like your saying I have done something wrong and they are actually right?

I have put most focus on Freepay on my site since they have the time limit, I was going to get them done first. So after a month of promoting them and getting them more referrals and making them money and also spending them money I at this very moment feel cheated and used.

If you read the ToC is states not only will they put that account that was reported on hold but all other accounts too and also items which are ready to be shipped out. So that means I probably won't receive my iTouch which I worked hard to get.

I will fight this Freepay and take every possible action as it seems they think they can do as they please and its totally ok.

Sorry dude but I'm not saying you've done anything wrong, what I am saying is that in their eyes you have.. they have a reason and they have their terms and conditions to back them up.. there's not much you or the bbb can do about it. You asked for a reason and they've supplied it.. the bbb doesn't have anymore power to find out more info then you do.

as for asking for info on where you've spammed, i'm guessing they're covered under their privacy policy not to have to supply the info.. if orange can get out of telling me a tracking number for a parcel i've order and is been sent to me, i'm sure freepay can get out of telling you where they recon you've spammed..

i really do wish you all the best but read around the net, you'll soon see its a losing battle..

edit - just checked your website and going by their t&c's, 1e

you could get put on hold for the following statment..

Quote:
That is true, but people miss a big major factor within these offers! FREE TRIALS! That’s right, there is offers that give free trials to dvd rental sites and so on, which means if you don’t like what the offer the site gives you then you simply cancle your deal and you don’t get charged a penny and you will get a completed status on your offer… Free any one?

Re: Very Annoyed, any advice?

Hi Jon,

List of methods I use to promote my site.

Web Directorys (To improve PR and backlinks)
SocialBookmarking (To improve PR and backlinks)
Forums (Only this one)
Article Marketing (Backlinks)

That's all I believe, I also have my site on my MySpace profile but I hardly use that.

Though I have not directly linked to my referral link through another site, so I am totally confused.

No problems dude, I wasn't attacking ya I know what your saying it's justed annoyed me that something I have really enjoyed doing and that I have knuckled down and sunk my teeth in has kicked me in the teeth in return.

Yeah I have read many stuff on the Internet regarding this issue, actually a lot is down to being put on hold but its not just a few its a lot of people. Just never thought I'd ever on the other end of the stick when reading the comments.

I have responded to their ticket responce, don't worry it was with a level headed responce and not a crazed manic guy pissed off lol.

I hope they see reason or pitty as I don't really want to see a month and half of work down the drain

It could well be "Article Marketing (Backlinks)" one blog owner see's a few links in the comments, does some looking etc etc, for them to give you that reply it means someone has reported you

Hmm it's possible but in most cases they would have just deleted my myspace account if it breached their ToC. Anyway I have had like 30 views I think since creating it lol, though just my luck one of them was old Tom

I'm actually diggin around now to see if my referal has been posted around by some one that hates me and my site...

You know their is some nasty people on the web, probably just my crappy luck that I have been screwed...

Thanks man and sorry if I sounded harsh in my recent posts, like I said I have sent a responce to freepay, they did extend my gaming account so maybe they will be on the same level as me and see I am not scammer out to rip them off.
