When i was 4 years old i died of Meningitis for a few minutes. My temperature rose so high that my brain shut down. From that point on i had major hastle with my parents when they tried to drag me to mass on Sundays.

Organized religion of any kind is a waste of time from my point of view. All i see is more & more bad things done in the name of religion & very few good things.

Nope, she didn't kill them did she. Would you think if her so kindly if she refused a tranfusion for her kids, and they died?

Whether you think someone should be punished depends purely upon the mode of ethics you prescribe to. I am an absolutist, with a bit of consequentialist. He didn't mean to kill her, but he did. The man who gets in a car so drunk he can't see and drives home doesn't intend to kill anyone, he believes he is fine. He then kills someone. This is still wrong. No matter what the reason, if someone causes a death because they didn't give them the proven medication, they should go to jail.

If your Doctor gives your epilectic partner glucose instead of Phenytoin Sodium, becuase they believe it will work, even if it's known Phenytoin works and glucose doesn't, and they die, I think you might have something to say about it.

Although he is guilty of his daughters death (i.e. his actions lead to her demise) I don't think he should go to prison.

Your own and someone else's daughter is completely different. If it was someone else's child their parent would want justice. If it's your own child additional punnishment is not neccessary as it was you who wrongly neglected a loved one.
